Nigeria FHC Kaduna Adjourns IMN Fundamental Rights Case Hearing

The Nigerian Federal High Court sitting in Kaduna, presided by Justice Saleh Shuaibu Musa, has yet again adjourned sitting in the case brought before it seeking to enforce the fundamental rights of members of the Islamic Movement in Nigerian (IMN) over technicalities.

At the resumption of sitting today, instead of hearing and adoption of all processes and written addresses, the court was entangled in the mesh of technical issues, which sought to kill the case even without hearing the substance of the case.

Counsel to the 8th respondent, the Chief of Army Staff, in the person of Barrister Malik, took the counsel to the Movement, Barrister Ajodoh over stamp and seal appended on the originating motions.

Malik, who earlier applied for leave of the court to file out of time and was granted, vehemently objected to the plaintiffs/applicants' counsel to regularize his processes in court.

It was clear that the counsel to the Army top chief wanted to kill the case before hearing. He had also filed a preliminary objection to the suit as a whole.

The court however granted Ajodoh leave to file his application citing all relevant authorities that would support his position of being allowed to regularize his processes prior to the hearing.

The case was therefore adjourned to 31st May, 2018.
